This agreement is governed by the laws of New Zealand and cannot be varied, except in writing by YOURCRUISE.
This agreement and terms implied by law comprise the entire agreement between the parties and supersede all previous negotiations and representations, whether written or oral unless agreed in writing under the Special Conditions in the YOURCRUISE’s Booking Form.
3. How to book
To make a Tour booking, YOURCRUISE requires a completed Booking form and a $500NZ non-refundable Deposit per person or, if the travel is to commence within 120 days of the booking, full payment is required at the time of booking. The person making the booking accepts these booking conditions on behalf of everyone in his/her party. If YOURCRUISE accepts your booking we will then issue you with a confirmation document, and the contract will then exist between us from the date we issue the Invoice of Confirmation.
If you are booking a Cruise, YOURCRUISE requires a copy of your passport and deposits are due as specified by the Cruise line, we will advise you when your deposit and full payment is due.
4. Check Confirmation
When you receive the confirmation document please check the details carefully and inform YOURCRUISE immediately if anything appears incorrect. This is particularly important as names etc. on travel documents need to match those on passports.
Payment of all monies due must be paid in full to YOURCRUISE no later than 120 days before the tour departure date. No reminders will be sent and in the case of non-payment of the balance YOURCRUISE will treat the booking as cancelled by you.
6. Cancellations and refunds
For Tours, – Cancellation fees apply to all reservations. The date of cancellation is the date on which YOURCRUISE receives the written cancellation notice, or non-payment of the balance under clause 5 above. Cancellation fees are as follows:- More than 180 days prior to departure – loss of $500NZ deposit. 180 days through to departure loss of 100% of total price of the tour. After the tour has commenced – No refunds will be made if you leave a tour for any reason whatsoever, whether voluntarily or involuntarily. YOURCRUISE reserves the right to cancel any trip before it is guaranteed to run, but will not cancel a tour less than 60 days prior. After the tour has commenced – No refunds will be made if you leave a tour for any reason whatsoever, whether voluntarily or involuntarily. YOURCRUISE reserves the right to cancel any trip before it is guaranteed to run, but will not cancel a tour less than 60 days prior to departure except as stated below. A tour is guaranteed to run once it has 10 fully paid travellers. YOURCRUISE reserves the right to cancel any tour, including a guaranteed tour, at any time prior to departure due to terrorism, natural disasters, political instability or any other external events which make it unviable for YOURCRUISE to operate our planned schedule. If YOURCRUISE cancels a tour on which you are holding a booking, you may choose between an alternative trip of the same value or a full refund of the monies paid. YOURCRUISE is not responsible for any incidental expenses that you may have incurred as a result of your booking such as visa, vaccinations, non-refundable flights or loss of enjoyment etc. There will be no refunds if you decide, for what ever reason, that you will not participate in any of the activities or meals planned as part of the tour.
For cruises, – Cancellation fees apply and differ for each cruise line. You will be given the Cruise Lines, terms and conditions at the time of booking, which outlines the cruise lines cancellation policy.
7. The Tour covers
All tour prices are per person, quoted as twin share and in New Zealand dollars. They are correct at the time of publication. Events beyond our control may result in price increases and surcharges, we reserve the right to pass on these increases to you. The price may change at anytime until full payment is received and the booking is confirmed. If we have to change any part of your booking because of events beyond our control, e.g. an airline changes its schedule or a hotelier overbooks our accommodation, changes in applicable taxes or charges we will make all reasonable efforts to notify you. YOURCRUISE tour includes the necessary transport to undertake the tour from the departure/return points as stated in the Itinerary. We include all sightseeing and meals listed in the itinerary. We provide you with our experience, service and the support of our tour guides.
8. The Tour does not cover
The tour only includes travel from and to departure/ return points as advertised in the tour itinerary. There is an added cost if these departure/return points do not relate to you. We do not cover Airport Taxes, meals other than specified, visas and passport fees, insurance of any kind and optional sightseeing, as well as laundry, postage, personal clothing, drinks or any other items of a personal nature.
9. Travel Insurance
We strongly recommend that you take out full travel insurance at the time of booking and some destinations insist on travellers having a full insurance policy.
10. Health and Fitness
YOURCRUISE strongly recommends you ask your doctor about current vaccinations requirements and any recommended preparations for your trip. It remains your own responsibility to ensure that you are aware of any health requirements for your travel destinations. Ensure that you have obtained all necessary vaccinations and you are to carry all vaccination documents. In general, some tours require some physical activity such as walking through a jungle or getting in and out of canoes etc, it is your responsibility to assess your fitness level as to whether you can do this or not. If at the time of the activity, you decide you do not want to or cannot do an activity that is in the itinerary, there will be no refund of that portion of the tour.
Travel is not always predictable; therefore YOURCRUISE’s itinerary can alter slightly. Sometimes it is the result of improvement or may be due to logistical practicalities, while at other times it could be reasons completely out of our control and we may not always be able to advise you in advance of these changes, hence we ask for your understanding and patience should this occur.
12. Maps and Photos
All maps and photos shown are for general information, therefore they may not reflect the actual circuit or geographic areas of your selected tour. This also applies to hotel rooms and the surroundings, as at times there is a need to book alternative accommodation.

14. Travel Documents
Passports and Visas – All travellers must carry a valid passport for international travel and many countries (including Asia) require that they are at least 6 months valid from the date of entry. Any fines, penalties or expenditure incurred as a result of the documents not meeting requirements will be your sole responsibility. It is also your responsibility that your passports, re-entry permits and visas are valid. YOURCRUISE gives no warranty that your passport/visa will meet entry requirements of a particular country as entry requirements may change.
Other Documents – Travel documents, such as airline tickets/ferry tickets may be subject to certain conditions and/or restrictions – being non-refundable, non-date-chargeable and subject to cancellation and/or amended fees. All travel documents are non-transferable. All airline tickets must be issued in the name of the passport/photo identity holder, some carriers will deny carriage if the name varies and the booking may be cancelled. It is your responsibility that all documents are well checked and correct. YOURCRUISE does not hold any responsibility for incorrect documents. No documents will be sent out unless the final payment has been received and any cheques are cleared. YOURCRUISE cannot accept responsibility for items lost in the mail, it is therefore important for you to contact us as soon as these items are received.
15. Travel Advice
YOURCRUISE makes no representations as to the safety conditions or other issues that may exist in any destination. For travel advice, please contact the New Zealand Ministry of Foreign Affairs and Trade or visit www.mfat.govt.nz . When travelling anywhere, put some sensible practices in place. Such as:- Don’t ever leave anything unattended or leave bags open. Don’t carry important documents, valuables or money in an open pocket and lock them away safely when you’re away from your room. When out and about remember that bags slung over the shoulder or on your back can be snatched, therefore keep the more important items close to your body. Bum bags can also be a bit of an invitation. Do as you would do at home, in general a dark alley is not a great place to hang out. Crowded places bring opportunists, pickpockets.
Travel light– If you can’t carry it, don’t bring it. If you don’t like carrying a backpack, select the smallest suitcase you can find. You’ll be stuck with it for the duration of the tour. Although our tours are not overly strenuous, and there is plenty of time to relax, we move around a lot. We catch planes, trains, ferries and buses. Also always check your baggage allowance for the plane, both for check in and cabin baggage. All carriers also have safety regulations in place to comply with. YOURCRUISE does not take any responsibility for your luggage or charges for excess baggage.
17. Roles and Responsibility
YOURCRUISE acts as an agent for transport companies, hotels, and other contractors and shall not be liable for any injury, damage, loss, delay or irregularity whatsoever that may occur. The traveller understands that during the course of the trip there are certain risks, such as illness or accident (without limitation) therefore the traveller agrees to assume all risks associated with the trip. YOURCRUISE has your safety and wellbeing in mind, therefore travellers accept the full authority of the Tour Guides at all times. We also have the welfare of the whole group in mind and accept no responsibility or liability for any traveller who contravenes any law or regulation of any country we visit. You are aware that travelling within a group may involve compromise to accommodate the diverse desires and physical abilities of the group. You accept that YOURCRUISE contracts with a network of companies, government agencies and individuals to assist in the running of the Tour. To the best of YOURCRUISE knowledge these third parties are qualified to perform the duties they are contracted to perform. However YOURCRUISE will not be held liable for any loss, damage, injury, delay or irregularity that may occur due to the behaviour of these third parties.
All information on this site is accurate to the best of our knowledge at the time of printing, but please note that changes to our trip (which can be significant) may need to occur. YOURCRUISE will make every effort to keep you informed of any changes, but cannot be held liable for any alterations made to the published itineraries. You acknowledge that while travelling on a YOURCRUISE at times we need to have a degree of flexibility and you accept that without prior notice there could be altered modes of transport accommodation and routes. Sometimes these changes are out of our control and you agree there maybe an extra charge to you.
19. Privacy Statement
YOURCRUISE collects personal information for the purposes of providing the tour. YOURCRUISE will need to pass this information onto the contractors providing the various services on the tour, including (but not limited to) hotels, and transport companies. YOURCRUISE will only use personal information that you provide to us for the purposes you supplied it, for directly related purposes or for other reasons permitted under the Privacy Act 1993. You may seek access to personal information held about you by YOURCRUISE in accordance with your rights under the Privacy Act. YOURCRUISE would like to contact you about future tours which may be of interest to you. Please let us know in writing if you do not want to be contacted about such tours.
